Welcome to Prompt Maschine. These Terms of Service ("Terms") govern your access to and use of the Prompt Maschine mobile application, website, and related services (collectively, the "Service"), operated by Prompt Maschine ("we", "our", "us").
By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into this agreement.
2. Your Account
If you create an account, you are responsible for maintaining the security of your credentials and for all activity under your account. Notify us immediately at hello@promptmaschine.com if you suspect unauthorized access.
3. Subscriptions & Payments
3.1 Billing
Prompt Maschine offers subscription plans (Monthly Pro and Annual Pro) purchased through the Apple App Store. Payments are processed by Apple and subject to Apple's terms and conditions.
3.2 Auto-renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your Apple ID account settings.
3.3 Refunds
Refunds are handled by Apple per their standard policy. We cannot issue refunds directly for purchases made through the App Store. You may request a refund at reportaproblem.apple.com.
3.4 Free tier & trials
We may offer a free tier or trial period with limited features. Free usage is subject to fair-use limits, which we may update at any time.
4. User Content
4.1 Ownership
You retain ownership of the lyrics, prompts, and other content you create using the Service ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, and process your User Content solely for the purpose of providing and improving the Service.
4.2 Responsibility
You are solely responsible for your User Content. You represent that your User Content does not violate any law or infringe any third-party rights.
4.3 AI-generated output
Output generated by the AI features of Prompt Maschine is provided "as is" and may be inaccurate, repetitive, or resemble existing works. You are responsible for reviewing AI output before using it commercially and for ensuring it does not infringe on third-party rights.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any law.
- Generate content that is defamatory, harassing, hateful, threatening, or that promotes violence or discrimination.
- Generate content that sexually exploits minors or depicts them in any inappropriate manner.
- Infringe the intellectual property rights of others.
- Attempt to reverse-engineer, decompile, or extract the source code of the Service.
- Use automated means (bots, scrapers) to access the Service without our prior written permission.
- Interfere with or disrupt the Service or its servers.
- Resell, sublicense, or redistribute access to the Service without authorization.
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Third-Party Services
The Service integrates with third-party platforms (Suno, Udio, Kaiber, YouTube, Apple) and AI providers. We are not responsible for the availability, content, or practices of those third parties. Your use of their services is governed by their respective terms.
7. Intellectual Property
The Service, including its design, logos, trademarks, and software, is owned by Prompt Maschine and protected by copyright, trademark, and other laws. These Terms do not grant you any rights to our intellectual property except as expressly stated.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that AI-generated output will meet your expectations.
9. Limitation of Liability
To the maximum extent permitted by law, Prompt Maschine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, data, or goodwill, arising out of or related to your use of the Service.
Our total liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $50, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless Prompt Maschine, its affiliates, and its personnel from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
11. Termination
You may stop using the Service at any time and delete the app. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. Sections that by their nature should survive termination (e.g., ownership, disclaimers, limitations of liability) will survive.
12. Changes to the Service & Terms
We may modify or discontinue parts of the Service at any time. We may also update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use after changes take effect constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Prompt Maschine is established, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the competent courts in that jurisdiction for any dispute arising out of these Terms.
